共享资源共享资源common property resources搭薰鬓巍凳潜鑫器著霎赢纂簇源有两个特性:一是具有公开通达性，即每个想使用它的人都可允许去接近它、利用它，而不能排斥他人的使用;二是在使用时具有某种排他性，即各个使用者之间相互排斥或有不利的相互影响。共享资源是经济学中一个传统名词，但其法律含义可能有所不同。英文又叫做~d，~es或open accessre~。在英国普通法、德国土地法和罗马法中把共享资源理解为财产权利的分配，它是对某一特定使用群体，对其使用者规定有明确的使用权利，而将非属于该群体的潜在使用者排斥在外。在这种法律体系下，许多自然资源系统曾得到良好的管理，以致持续利用达数百年之久。如原始部落的狩猎资源，至今犹存的英格兰及威尔士的公共土地，巴伐利亚、瑞士和奥地利的阿尔卑斯山草地以及通过严格水法管理的诸多河流。在自然资源系统中共享资源种类繁多。它包括荒原上的野生动植物、公共水域、地下水层、大气层等。由于这类自然资源可以自由共享，因此产生了种种问题，如不能促使使用者节约使用资源，使得使用者可以把人类共同拥有的大气层和水体当成了个别集团和个人的当然排废场所而不顾忌环境的后果等。共享资源的问题源于允许每个人都可使用这种资源而不能排斥他人使用这种资源的权利，每个人都担心在未利用这种资源之前就被他人用尽，因此造成每个人都想争先使用，致使共享资源利用过度、加速耗竭，乃至破坏资源的再生能力。根据资源本身特点，共享资源问题大体有以下3种类型:①利用共享资源经营产业活动导致资源过度利用和加速耗竭。如公共水域中的捕鱼业，公共水域中的鱼群既有共享资源特性，又有生物保护特性。未来捕鱼量决定于水域中的现有鱼存量，鱼存量过小或过大都不利于下期捕鱼量，在鱼存量适度时捕鱼量可达到最大，即达到社会最佳捕鱼量，这时社会可获得最佳收益，而生产者可得到高额利润。由于它是共享资源，不能实现这种均衡，反而会刺激新的生产者参与或者投人更多的设备，用以增加捕鱼量，最终使生产者无高额利润可得，社会也可能得不到任何净效益，资源受到过度利用乃至枯竭。②共享资源作为公用设施而被利用时所产生的拥挤现象。最常见的例子如公路、机场、港口、海滩、公园、旅游胜地(参见彩图插页第13、第14页)等。必要条件是这些公用设施不能在短期内根据使用者的需求而扩大。因为拥挤降低了使用者利用效果，从而使使用者减少其原支付的报酬或者增加等候的经营成本。解决的办法只能是加强管理、不超量使用和适当征收费用。③环境作为共享资源而成为污染的载体。大多数立法体系下，大气层、水体和广阔的田野常常成为排放废水、废气、废翼输机场(英国)(《商业先锋》)渣的共享资源。
